These Terms & Conditions apply to visitors and customers using naturalgemsbelgium.com and to contracts concluded through our online store.

Natural Gems Belgium specialises in natural gemstones, crystals, mineral specimens, jewellery, carvings, decorative pieces and related products.
Natural gemstones, crystals and minerals are products of natural geological processes. Individual specimens may therefore display natural variations and characteristics including inclusions, colour zoning, internal features, surface-reaching features, growth structures, variations in transparency, irregularities and differences in colour, pattern, shape, dimensions or weight.
These characteristics may form part of the natural identity of the material and do not automatically constitute defects.
Where a product is individually documented, photographed, measured, graded, described or assigned a Natural Gems Belgium reference, the information relates to that individual specimen unless expressly stated otherwise.
Many products offered by Natural Gems Belgium are unique individual pieces. Once an individual specimen has been sold, an identical replacement may therefore not be available.
Nothing in this section affects a consumer’s statutory rights where a product does not conform to the sales contract.
PRODUCT INFORMATION, IDENTIFICATION AND GRADING
We make reasonable efforts to provide accurate and meaningful information concerning our products.
Depending on the product, information may include gemstone species or variety, weight, dimensions, colour, transparency, clarity, origin where known or supported, treatment information, cutting style, natural characteristics, gemmological properties, grading information and other specimen-specific observations.
Natural Gems Belgium grading, evaluation notes, reports, verification pages and similar information represent our assessment of the individual product according to the methodology and information applicable at the time of evaluation.
Unless expressly identified as a report or certificate issued by an independent gemmological laboratory, Natural Gems Belgium documentation should not be represented as an independent third-party laboratory certificate.
Where an independent laboratory report accompanies a product, the identity and findings of that laboratory will be stated separately.
Gemstone grading and certain descriptive characteristics inherently involve professional observation and may contain an element of judgement. Reasonable differences of professional opinion do not by themselves establish that a product is defective or incorrectly supplied.
Mandatory statutory rights remain unaffected.
TREATMENTS AND ORIGIN
Where information concerning gemstone treatments is available and relevant, Natural Gems Belgium seeks to disclose that information in the product description or accompanying documentation.
Where a gemstone is described as untreated, unheated or as having a particular treatment status, the statement is based on the information, examination or documentation reasonably available for that individual product.
Geographic origin will only be stated where Natural Gems Belgium has a reasonable basis for doing so. Unless expressly supported by an independent laboratory origin determination, an origin statement should not be interpreted as an independent laboratory opinion.
Natural gemstones can sometimes require advanced laboratory testing to conclusively establish certain treatments or geographic origins. Product information should therefore be read together with any specimen-specific documentation provided.
PRODUCT IMAGES AND COLOUR REPRESENTATION
We make reasonable efforts to photograph and display our products accurately.
The appearance of gemstones and other natural materials may vary depending on lighting conditions, viewing angle, background, magnification and photographic conditions.
Colours may also appear differently depending on the screen, device, display calibration and settings used by the customer.
Images are therefore intended to provide an accurate visual representation but cannot guarantee that every display will reproduce colour identically to viewing the physical product under the same lighting conditions.
Where photographs show an individual gemstone or specimen, we endeavour to use images of the actual item unless otherwise clearly indicated.
PRODUCT AVAILABILITY
Products displayed on our website are subject to availability.
Because many Natural Gems Belgium products are individual or unique specimens, stock may be limited to one piece.
Placing a product in a shopping cart does not necessarily reserve that product unless the website expressly indicates otherwise.
In the exceptional event that a product becomes unavailable after an order has been placed, we will inform the customer and, where payment has already been received and the order cannot be fulfilled, refund the applicable amount.
PRICES
Product prices are displayed on the website in the applicable currency and with taxes handled in accordance with the tax rules applicable to the transaction.
The final price payable, together with applicable shipping charges and other amounts collected by Natural Gems Belgium, will be shown during checkout before the customer confirms the order.
For international orders, customs duties, import taxes, clearance fees or similar charges imposed by the destination country may apply. Unless expressly stated at checkout that such charges are collected by Natural Gems Belgium, they remain outside the amount collected by us and may be payable by the recipient.

OBVIOUS PRICING OR INFORMATION ERRORS

Where an obvious error is identified before an order has been accepted or fulfilled, we will contact the customer where appropriate and provide the legally appropriate solution.

PLACING AN ORDER

Where an order is cancelled by Natural Gems Belgium after payment has been received and no alternative arrangement is agreed with the customer, the applicable amount will be refunded.
PAYMENT
Payment must be made using one of the payment methods available during checkout.
Available payment methods may vary according to country, currency, transaction value or other legitimate payment-processing conditions.
Payment transactions may be processed by external payment service providers.
Natural Gems Belgium does not require customers to provide complete payment-card credentials directly to us where those credentials are processed securely by the relevant payment service provider.
An order may remain pending until payment has been successfully authorised or confirmed where payment is required before fulfilment.
ORDER SECURITY AND FRAUD PREVENTION
We may take reasonable measures to verify orders and protect customers and Natural Gems Belgium against fraud, unauthorised transactions or misuse.
An order may be temporarily held, reviewed or cancelled where there are reasonable grounds to suspect fraudulent or unlawful activity.
We may contact the customer to verify information where reasonably necessary.
These measures will be applied in accordance with applicable law and our Privacy Policy.
SHIPPING AND DELIVERY
Orders are prepared and shipped in accordance with our Shipping & Delivery Policy.
Our standard objective is to dispatch orders on the next business day after payment has been confirmed, subject to circumstances described in the Shipping & Delivery Policy.
Tracking information is provided for shipped orders and may also be made available through the customer’s account where supported by the relevant shipping service.
Delivery estimates are estimates rather than guaranteed delivery dates unless expressly agreed otherwise.
International shipments may be subject to customs procedures, import formalities, duties or taxes in the destination country.

RIGHT OF WITHDRAWAL, RETURNS AND CANCELLATIONS
Consumers who qualify for the statutory European Union right of withdrawal generally have 14 calendar days from receipt of the goods to notify Natural Gems Belgium of their decision to withdraw from an eligible distance contract, subject to the conditions and exceptions established by applicable law.
After valid notification of withdrawal, the goods must be returned within the applicable statutory period.
Where legally permitted and where the customer has been informed accordingly, the direct cost of returning goods following a change-of-mind withdrawal is borne by the customer.
Separate rules apply where goods are damaged, incorrect, defective or otherwise not in conformity with the contract.
Orders may also be cancelled before fulfilment where cancellation remains operationally possible.

Nothing in these Terms & Conditions limits a consumer’s statutory right of withdrawal or other mandatory consumer rights.
REFUNDS
Refunds are administered in accordance with applicable law and our Return, Refund & Cancellation Policy.
Where a statutory withdrawal is validly exercised, refunds will include amounts required by applicable consumer law, including the standard outbound delivery cost where legally required.
Additional costs resulting from a customer’s choice of a more expensive delivery method than the least expensive standard delivery option offered by Natural Gems Belgium do not have to be reimbursed where applicable law permits this.
Refunds will normally be made using the original payment method unless the customer expressly agrees to another legally permitted method.
Natural Gems Belgium Store Credit may be offered as an alternative where available, but will not replace a monetary refund where the customer is legally entitled to such a refund unless the customer expressly chooses store credit.
DAMAGED, INCORRECT OR LOST ORDERS
If an order arrives damaged, contains an incorrect product or appears to have been lost during delivery, please contact Natural Gems Belgium as soon as reasonably possible so that the matter can be investigated and resolved.
We may request reasonable supporting information, such as photographs of damaged products or packaging, where necessary to assess a claim.
A request to report shipping damage promptly is intended to assist investigation with the carrier and does not remove statutory consumer rights.
The customer’s rights in relation to defective or non-conforming goods remain governed by applicable law.
LEGAL GUARANTEE AND CONFORMITY
Consumers benefit from the mandatory legal guarantee and conformity rights provided by applicable Belgian and European Union consumer law.
Goods supplied by Natural Gems Belgium must conform to the sales contract as required by law.
Nothing in these Terms & Conditions, our product descriptions, grading information, return procedures or other policies excludes or restricts rights that cannot legally be excluded or restricted.
Natural characteristics that were accurately disclosed and are inherent to the individual gemstone, mineral or other natural material do not by themselves constitute a lack of conformity.

You must take reasonable steps to protect access to your account and any email account or authentication method used to access it.

STORE CREDIT
Natural Gems Belgium may provide Store Credit as part of customer-service, refund, promotional or loyalty functionality.
Where Store Credit is offered as an alternative to a refund to which a consumer is legally entitled, the customer’s express choice will be required.
Store Credit does not replace statutory refund rights without the customer’s agreement.
Any specific conditions relating to promotional or bonus credit will be communicated when such credit is issued.
Unless expressly stated otherwise and legally permitted, Store Credit is intended for purchases from Natural Gems Belgium and is not transferable or redeemable for cash.
Nothing relating to Store Credit limits mandatory consumer rights.
